2. Services Provided
2.1 Scope of Services
Gold Coast Fence Repairs provides fence repair, maintenance, and installation services, including:
- Colorbond and steel fence repairs
- Timber fence repairs and replacement
- Pool fence repairs and compliance certification
- Gate repairs and automation
- Retaining wall repairs and stabilisation
2.2 Quotes & Estimates
- Free quotes — we provide free on-site assessments and written quotes for all jobs
- Quote validity — quotes are valid for 30 days from the date provided
- Verbal quotes — any quote provided verbally is indicative only; a written quote supersedes it
- Non-binding — accepting a quote does not create an obligation; you may accept or decline at any time
2.3 Pricing & Invoicing
- Fixed-price quotes — prices provided in our quote include labour, materials, and GST unless otherwise stated
- Variations — if unforeseen issues arise during work (e.g., hidden rot, ground conditions), we will notify you and discuss additional costs before proceeding
- Invoicing — invoices are provided upon completion of work; payment is due within 7 days of invoicing
- Payment methods — we accept cash, bank transfer, credit card, and cheque
2.4 Scheduling & Timelines
- Booking — once you accept a quote, we will confirm a scheduled date for the work
- Timeline — most repairs are completed within the timeframe quoted; delays may occur due to weather, unforeseen damage, or supply issues
- Cancellation by customer — cancellations made within 48 hours of scheduled work may incur a consultation or cancellation fee
3. Customer Responsibilities
3.1 Site Access & Preparation
- Clear access — the customer is responsible for ensuring we have safe access to the fence and work area
- Hazard disclosure — you must inform us of any hazards (e.g., unstable ground, underground utilities, aggressive animals)
- Utility location — it is the customer's responsibility to mark/identify underground utilities (gas, water, electricity) on the property
- Third-party property — if the fence is a boundary fence, you must ensure you have the right to proceed without the neighbour's permission (or have obtained it)
3.2 Payment
- Timely payment — payment is due within 7 days of invoicing
- Late payment — unpaid invoices may accrue interest at 10% per annum
- Failure to pay — if payment is not received, we reserve the right to suspend future services or recover costs through legal action
3.3 Communication
- Response to contact — if we contact you with questions or updates, please respond promptly to keep work on schedule
- Change requests — notify us immediately of any changes to the scope of work; late changes may incur additional costs
4. Workmanship Warranty
4.1 Warranty Period
We guarantee our workmanship for 12 months from the completion date. If a repair fails due to our work (not normal wear, abuse, or third-party damage), we will correct it at no cost.
4.2 Warranty Exclusions
The warranty does not cover:
- Normal wear and tear — weathering, colour fading, minor surface damage
- Customer abuse or misuse — damage caused by customer actions or negligence
- Third-party damage — damage caused by weather, storms, animals, or third parties
- Alterations — if you modify the repair after completion (e.g., paint over our work, alter the fence)
- Material defects — defects in supplied materials beyond our control (covered by manufacturer warranty)
4.3 Material Warranties
Materials used (Colorbond, timber, hardware, etc.) come with their own manufacturer warranties. We will provide you with relevant warranty details upon request.
5. Liability & Indemnification
5.1 Our Liability
To the maximum extent permitted by law:
- Limited liability — our total liability for any claim arising from our services is limited to the amount you paid for the repair
- No consequential damages — we are not liable for indirect, incidental, or consequential damages (e.g., loss of rent from an investment property, business interruption)
- Insurance — we carry public liability insurance ($10M+ coverage) to protect you in case of property damage or injury caused by our work
5.2 Your Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or costs arising from:
- Third-party disputes — neighbour disputes or disagreements over fence ownership or cost-sharing
- Non-disclosure of hazards — your failure to disclose hazards (utilities, unstable ground, etc.)
- Regulatory violations — your failure to obtain necessary council permits or approvals
- Payment disputes — claims arising from unpaid invoices
6. Council Permits & Regulations
6.1 Customer Responsibility
- Permits — the customer is responsible for obtaining any required local council permits or approvals before work commences
- Regulations — we will advise on applicable building codes and regulations, but the customer is responsible for compliance
- Property boundaries — you must ensure the fence is within your property boundaries; boundary disputes are your responsibility
6.2 Pool Fence Compliance
- Compliance certification — for pool fences, we will issue a compliance certificate under Queensland Building Code Section 12 upon satisfactory completion
- Inspection responsibility — the customer is responsible for keeping the pool fence maintained to ensure ongoing compliance
- Safety — a compliant fence is no substitute for active supervision of children and pool access control
7. Intellectual Property
- Photos & before/after — we may photograph your fence repair for portfolio, marketing, or review purposes; you grant us a non-exclusive licence to use these images (with your address/identifying details removed or pixelated)
- Opt-out — if you do not wish your fence to be photographed for marketing, notify us before work begins
8. Limitation of Services
8.1 What We Don't Do
We do not:
- Structural engineering — advise on structural issues beyond fence repairs (refer to a structural engineer)
- Boundary disputes — settle disagreements over fence ownership or cost-sharing (mediate with council or solicitor)
- Regulatory compliance — guarantee your fence will pass council inspection (we advise, but council has final authority)
8.2 Scope Limitations
- Unforeseen issues — if we discover issues beyond the quoted scope (e.g., extensive rot, structural damage), we will contact you before proceeding
- Termination — you may cancel work in progress, but labour already expended and materials used will be invoiced
9. Dispute Resolution
9.1 Complaints Procedure
If you have a complaint about our work:

- Investigation — we will investigate the complaint and respond within 10 business days
- Resolution — we will propose a remedy (repair, credit, refund)

- Legal jurisdiction — these terms are governed by the laws of Queensland, Australia; disputes are resolved in the District Court of Queensland
10. Cancellation Policy
10.1 Cancellation by Customer
- More than 48 hours notice — full refund of any deposit paid
- Less than 48 hours notice — $150–$250 cancellation fee (consultation + scheduling costs)
- Cancellation during work — you will be invoiced for all labour expended and materials supplied
10.2 Cancellation by Us
We may cancel or postpone work if:
- Safety concerns — hazards prevent safe work
- Non-payment — you default on payment terms
- Third-party interference — third parties prevent access or work
In these cases, we will notify you immediately and discuss next steps.
11. Health & Safety
11.1 Our Obligations
- Workplace health & safety — we comply with relevant health and safety regulations and standards
- Insurance — we carry workers' compensation and public liability insurance
- Safe work — we will conduct work safely and in accordance with industry best practices
11.2 Your Obligations
- Site safety — you are responsible for ensuring the work site is safe (e.g., no hazards, clear access)
- Visitor safety — if visitors or family members are present during work, you are responsible for their safety
- Animal control — if you have animals on the property, you must ensure they are secured during work
12. Privacy & Data
We collect and use personal information (name, phone, address, email) as described in our Privacy Policy. By requesting a quote or engaging us for services, you consent to data collection and use in accordance with our Privacy Policy.
13. Guarantee & Warranty Disclaimer
13.1 Service Guarantee
We guarantee:
- Professional workmanship — work will be completed professionally and in accordance with industry standards
- Quality materials — we use quality materials suited to the Gold Coast climate
- Licensing — our team is QBCC-licensed and fully insured
13.2 Disclaimer
Except as expressly stated in this agreement, we make no other warranties or guarantees, including:
- Fitness for purpose — repairs are not guaranteed to solve every issue permanently (e.g., if rot returns due to ongoing moisture, further maintenance may be needed)
- Durability — we cannot guarantee repairs will last indefinitely; normal wear, weather, and climate will affect fence longevity
- Third-party materials — we do not warrant third-party materials (Colorbond, timber, hardware) beyond manufacturer warranty
14. General Provisions
14.1 Entire Agreement
These Terms & Conditions, together with our Privacy Policy and the quote you accept, constitute the entire agreement between you and us regarding our services.
14.2 Severability
If any part of these terms is found to be unenforceable, the remaining provisions remain in effect.
14.3 Assignment
You may not assign your rights under this agreement without our consent. We may assign our rights to a successor or related company.
14.4 Waiver
Our failure to enforce any term does not constitute a waiver of that term; we reserve all rights.
